Legal
Terms of Service.
Last updated August 2026
These terms are an agreement between you and Dumaguete Pty Ltd ABN 47 637 375 298, trading as PACT (“PACT”, “we”), and apply when you use the platform or pay for a tier.
What PACT is
PACT is a document drafting and evidence platform for family loans. PACT is not a lender, does not hold, move, or lend money, and does not provide legal, tax, or financial advice. Documents are assembled from a versioned clause library approved by an independent panel law practice.
What you agree to
You confirm that the information you provide during intake is true and complete to the best of your knowledge, that you are entitled to enter the agreement you are documenting, and that you will use PACT only to document genuine arrangements between the named parties.
Acceptable use
You must not use PACT to document sham arrangements, to disguise the true nature of a transfer, or for any unlawful purpose. We may suspend access for breach, but you retain export access to executed evidence bundles.
The document and its limits
PACT assembles a document from your answers using a deterministic clause library. It does not tailor legal advice to your circumstances. You are responsible for reading the document and deciding whether it suits your situation — and you are free to seek your own advice before signing. On the Certified tier, your matter is reviewed by an independent panel law practice, which provides that review to you under its own engagement terms. PACT is not a law practice and the review is not provided by PACT.
Our liability
Nothing in these terms excludes any guarantee or right you have under the Australian Consumer Law. To the extent the law permits, our liability for any failure of the service is limited to resupplying the service or refunding the amount you paid for it, and we are not liable for indirect or consequential loss. PACT documents your agreement; it does not guarantee any legal, tax, family law, social security, or estate outcome.
Your document
You have a perpetual licence to use, copy, and share any document assembled for your matter. The clause library and platform remain ours (and our panel law practice's). You permit us to retain executed documents and evidence records for the evidence function, including after your account closes.
Payments
One-off tier fees are payable at checkout, handled by an independent payment processor — PACT never sees or stores card details. Repayments under any loan you document move directly between the parties' own bank accounts — PACT never holds or transfers those funds. Ledger subscription terms, where applicable, are shown before you subscribe.
Refunds
Tier fees are refundable before your document is assembled, and afterwards where the Australian Consumer Law requires. Any ledger subscription can be cancelled at any time, effective at the end of the billing period.
Execution and evidence
Agreements are executed electronically under the applicable Electronic Transactions Act. PACT records signatures, timestamps, and device details, and retains a hashed, append-only evidence record, designed so it cannot be altered after the fact — that permanence is the point of the service.
Continuity
Evidence bundles are self-contained and exportable at any time. Document hashes are standard SHA-256 fingerprints and can be independently verified with common tools, without any involvement from PACT. If we ever discontinue the service, we will give at least 90 days' notice and provide your complete bundle before shutdown.
Changes to these terms
We may update these terms with at least 14 days' notice for material changes. Changes apply prospectively only — never to a matter already executed. If you don't accept a change, you may close your account and export your evidence bundle.
Governing law
These terms are governed by the laws of New South Wales, and the parties submit to the non-exclusive jurisdiction of its courts.
